We consistently complete Risk Assessment Method Statements (RAMs) to identify potential hazards before beginning any tree surgery project, adhering to our core principle of “safety first, every time.” However, beyond fundamental safety, we’ve discovered that RAMs offer substantial additional benefits, providing protection in several crucial areas.
What protection does a risk assessment provide?
While a risk assessment like a RAM helps us manage risk (rather than eliminate it entirely), the level of legal protection it affords is critical. In the UK, failing to conduct an adequate risk assessment can lead to severe legal repercussions:
- Breach of health and safety legislation: Under the UK Health and Safety at Work Act 1974 and the Management of Health and Safety at Work Regulations 1999, employers are required to ensure the health, safety, and welfare of their employees and others who may be affected by their work activities. This includes carrying out risk assessments and, where necessary, creating specific method statements (like a RAM) for high-risk activities. Failure to do so can lead to non-compliance with these laws.
- Enforcement actions by the Health & Safety Executive (HSE): The HSE, which is the body responsible for enforcing health and safety at work in the UK, has the authority to issue enforcement notices, improvement notices or, more seriously, prohibition notices if a company has failed to comply with safety laws.
- Criminal liability: In serious cases, non-compliance can lead to prosecution. If inadequate risk assessment leads to an accident or injury, the responsible parties could face significant fines or even imprisonment, especially if negligence is identified. Following the introduction of the Corporate Manslaughter and Corporate Homicide Act 2007, companies can also be prosecuted if a gross breach of a duty of care is deemed to have contributed to a death.
- Civil claims for compensation: If an employee or any other individual is injured because of inadequate risk management, they may claim compensation. The absence of a risk assessment can also be used as evidence of negligence in civil litigation. The company could be held liable for damages, which can be substantial, depending on the severity of the injury and the impact on the individual’s life.
- Impact on insurance: Failing to adhere to legal requirements for risk assessment can adversely affect a company’s insurance cover. Insurance providers may refuse to cover claims related to incidents that could have been prevented by following proper risk assessment procedures. Moreover, the insurance premiums could increase due to perceived higher risks.
- Damage to reputation: Beyond legal and financial repercussions, there’s a significant reputational risk. Companies found lacking in their health and safety obligations may suffer damage to their reputation, potentially affecting business relationships and opportunities, especially with clients who prioritise compliance and safety standards.
Given these potential consequences, it’s unsurprising that our larger clients require a RAM for every project they commission – often a document over 30 pages long!

The RAMs process
Although a vital aspect of our operations, producing detailed RAMs for each project takes a long time. To address this, we turned to SVC Solutions who created a bespoke RAMs template with dropdown selections and a comprehensive risk assessment covering all potential hazards specific to our industry.
Now, when a project comes in, we provide SVC with essential details such as the task overview, site location, and required equipment. They then customise the template, accordingly, ensuring all safety measures are precisely tailored to the project’s needs, including any necessary COSHH assessments.
